Patentative

One-time review

Find what your pending patents can still claim

Send a patent, an application or a portfolio. We find competitor products your pending specifications may support claims covering. Or name a product and we review that one.

How it works

  1. 1

You send a patent or portfolio

A patent, an application or a list of them. Naming a competitor product is optional.
  2. 2

    We check the family

Which members are still pending, and the last day to file a continuation.
  3. 3

We match products to the spec

Competitor products from public documents, each feature checked for §112 support in the as-filed text.
  4. 4

    You get a cited report

By email, for review by your registered patent practitioner.

What we don’t do

  • Not legal advice. Patentative is not a law firm.
  • Your registered patent practitioner decides what, and whether, to file.
  • If nothing has strong support, we say so and show the closest passages.

Questions

Do I have to name a competitor product?

No. Send the patent, application or portfolio and we look for competitor products in public documents. If you have a product in mind, send a link and we review that one.

The parent is allowed or the issue fee is paid. Is it too late?

Not necessarily. A continuation filed on or before the parent’s issue date is co-pending (MPEP 211.01(b)). Paying the issue fee does not close the window, but patents issue shortly after payment, so the MPEP calls filing before payment best practice.

Is it proper to write claims aimed at a competitor’s product?

Yes, if the specification supports them. The Federal Circuit has said it is not “in any manner improper” to amend or add claims to cover a competitor’s product learned of during prosecution (Kingsdown v. Hollister, 1988). The new claims still need written-description support in the original filing (PIN/NIP v. Platte, 2002), which is why every review includes a support check.

Do you need anything confidential?

No. Send only published application, publication or patent numbers and, if you like, public product links. If confidential or unpublished material arrives, we delete it without using it.
