About

We find claims your pending applications can still support, before the window closes.

When a competitor launches a product, Patentative checks whether a pending US patent family can still support claims covering it. We cite the as-filed paragraphs that may support those claims, draft 1–3 example claims, and flag the continuation deadline under 35 U.S.C. §120. You get a written report by email within 48 hours, prepared for review by your registered patent practitioner.

Why it exists

A patent family stays open while any member is pending. A continuation can take new claims, as long as the original specification supports them. It must be filed on or before the day the parent issues (MPEP 211.01(b)). How the deadline works.

Competitors often launch products that use features a pending specification describes but does not claim. Claiming them is legitimate: there is “nothing improper” in amending or adding claims to cover a competitor’s product (Kingsdown v. Hollister, Fed. Cir. 1988). The limit is written description. What the specification must show.

In small and mid-size prosecution firms, finding these is usually manual and occasional: someone happens to notice a product. Often that is after the parent has issued, when the window has closed.

Timing now costs money too. Since Jan 19, 2025, a continuation filed more than 6 years after the earliest benefit date carries a $2,700 fee for a large entity, rising to $4,000 after 9 years (37 CFR 1.17(w)). The surcharge explained.

How we work

Public USPTO data
Family status, continuity and documents come from the USPTO Open Data Portal.
The as-filed specification
Support is checked against the specification as filed, by paragraph number, not against a summary or the claims.
Every citation checked
Each cited paragraph is matched against the as-filed text. Reviews are prepared with software and checked by a person before they are sent.
Written report within 48 hours
You receive the report by email. Everything stays in writing.
No calls
No demos, no sales calls, no meetings. Questions are answered by email.
Published information only
We ask only for published application or patent numbers and public product links. Anything unpublished is deleted unread.

What we are not

Patentative is not a law firm

No one at Patentative is registered to practice before the USPTO. Our reports are technical information for review by a registered patent practitioner. They are not legal advice and not a patentability, validity or infringement opinion. We don’t prepare, file or prosecute applications. Your practitioner decides whether and what to file.

Principles

Verifiable sources
Every statement in a report points to a paragraph, a USPTO record or a public product page you can open yourself.
Honest outcomes
“No strong support found” is a valid result, and we say so plainly. Weak support is labelled weak.
Quotes before work
The first reviews are free. After that, we quote by email before any work starts. Contact us.
